The Attorneys

Nicole Duncan, Esq.
Founder & Managing Attorney

Before becoming an attorney, Nicole built and operated several businesses, co-founded an investor-backed startup, and managed a seed-stage investment fund. That experience continues to inform her approach to business valuation, executive compensation, and other complex financial issues that arise in family law.

Nicole also experienced the effects of a high-conflict divorce within her own family at a young age. That perspective reinforces her belief that family law is about more than resolving legal disputes. It is about helping clients make thoughtful decisions that protect their children, their finances, and their future.

Holly Duncan, Esq.
Lead Counsel, Colorado

Holly anchors the firm’s Denver office, practicing Colorado family law since 2010 with a psychology background and a client base built substantially on referrals — handling divorce, custody, and support throughout Colorado.

Common Questions

Straight answers to the questions clients ask first.

How long does a divorce take in California?

California has a mandatory six-month waiting period from the date the respondent is served, so no divorce is final sooner than that. Uncontested matters often conclude near that minimum; cases involving complex property or contested custody commonly take a year or longer.

Can I move away with my child?

Not without either the other parent’s agreement or a court order. California move-away requests turn on the existing custody arrangement, the child’s best interest, and the evidence presented.

Do I need a forensic accountant?

In high net worth or business-owner divorce cases, forensic accountants may assist with valuation, tracing, income available for support, reimbursement claims, and hidden asset analysis.

How is support calculated?

Child support follows a statewide guideline formula driven primarily by each parent’s income and parenting time. Spousal support is more discretionary, especially when income is disputed or business ownership is involved.

What happens to my business in divorce?

A business started or grown during the marriage may be community property in whole or in part and may need to be valued and divided, often through a buyout rather than a sale.

When should I hire a divorce attorney?

The earlier the better, especially if you have children, assets, business interests, separate property claims, or urgent safety concerns. Early strategy often prevents expensive mistakes.
