Parentage Defined

What a Parentage Case Actually Is

A parentage action is filed under California’s Uniform Parentage Act FC §7600 et seq. with a Petition to Establish Parental Relationship. It asks the court to do up to four things:

  • Declare who the child’s legal parents are. This is the foundation. Every other order depends on it.
  • Make custody and visitation orders — legal custody (decision-making) and physical custody (the actual schedule).
  • Order child support under the same statewide guideline formula used in divorce, including childcare, health insurance, and add-on expenses.
  • Allocate attorney fees so that the parent with less income isn’t litigating against a parent who can outspend them FC §7605.

Here is the point most unmarried parents miss, and it cuts both ways. A father who has been seeing his child every weekend for two years has no enforceable custody rights until a court says he is the legal parent and issues orders. A mother raising a child alone has no enforceable support until the same thing happens. The informal arrangement works until the day it doesn’t — a move, a new partner, a disagreement about school — and on that day, the parent without orders has nothing to enforce.

Paths to Legal Parentage

How Parentage Is Established in California

California law recognizes several independent paths to legal parentage. Which one applies — and what happens when two of them conflict — is where these cases get technical.

Voluntary Declaration of Parentage (VDOP)

Most unmarried parents sign a Voluntary Declaration of Parentage at the hospital when the child is born FC §§7570 et seq.. A properly executed VDOP has the force of a judgment of parentage FC §§7573, 7644. What it does not do is create any custody, visitation, or support orders. Parents with a VDOP still need to open a court case to get enforceable orders — the VDOP just means the parentage element is already done. There are short statutory windows to rescind or challenge a VDOP, so if you signed one and have doubts, the time to act is now, not later.

Genetic testing

Where biological parentage is disputed, the court can order genetic testing. Modern testing is effectively conclusive on biology — but biology is not the end of the analysis in California, which is precisely why these cases need a lawyer rather than a lab.

The parentage presumptions

California presumes parentage in several situations FC §7611, and the most litigated is the “holding out” presumption: a person who receives the child into their home and openly holds the child out as their own is presumed to be a legal parent — regardless of genetics. The child of spouses who cohabited at the time of conception and birth is conclusively presumed to be a child of the marriage FC §7540, subject to narrow exceptions. When a biological father, a presumed father, and a VDOP signatory are not the same person, the court has to weigh competing claims — and in limited circumstances California courts can even recognize more than two legal parents FC §7612(c). If your case involves competing presumptions, the early procedural moves matter enormously, and mistakes are hard to unwind.

Assisted reproduction and same-sex parents

For children conceived through assisted reproduction, consent to the procedure — not genetics — generally controls parentage, and that consent generally must be in writing and signed FC §7613. The UPA’s presumptions apply equally to same-sex parents. These cases are usually about paperwork done right at the front end; when it wasn’t, they become parentage litigation, and we handle them as such.

Custody for Unmarried Parents

Custody and Visitation Between Unmarried Parents

Once parentage is established, the custody analysis is identical to a divorce case. Both parents are equally entitled to custody as a starting point, and the court decides legal and physical custody under the best-interest standard, with the same statutory preferences for frequent and continuing contact with both parents — except where there has been abuse.

Everything we litigate in dissolution custody disputes shows up here: contested custody and parenting schedules, move-away requests, Evidence Code §730 custody evaluations, and the domestic violence presumption. A DV finding within the previous five years creates a rebuttable presumption against awarding sole or joint legal or physical custody to the perpetrator FC §3044 — in parentage cases exactly as in divorce. We have written the definitive guide on how §3044 actually operates in court, and we litigate it from both sides, including alongside DVRO proceedings.

One Los Angeles-specific point: before a contested custody hearing, parents attend child custody mediation through Family Court Services. In Los Angeles County the mediation is confidential — the mediator does not make a recommendation to the judge. That changes preparation strategy: the hearing, not the mediation, is where the case is decided, and your declarations and evidence need to be built for it.

Complex Income & Support

Child Support When the Income Is Complicated

Guideline child support is a formula. The formula is not the fight. The fight is over the inputs: what each parent actually earns, and what percentage of time the child spends with each parent.

For W-2 parents, income is easy. But Los Angeles parentage cases routinely involve a parent who owns a business, works through an LLC or loan-out, earns irregular entertainment or gig income, or receives equity compensation. Self-reported income has a way of shrinking the month a support case is filed. This is where our practice is different: we approach a contested-income support case the way we approach a high-asset divorce — with targeted discovery, business records, and forensic accounting where the numbers justify it. Perks run through a company, deferred compensation, and depressed owner salaries are all reachable in the support analysis.

Two more points parents should know. Support in a parentage action can generally be ordered retroactive to the date the petition or initial pleading was filed, subject to statutory service limitations FC §4009: if the paying parent was not served within 90 days of filing and was not evading service, support generally cannot begin earlier than the date of service. Delay has a price — for both sides. And if the local child support agency is already involved, you can still have private counsel; the agency represents the state’s interest in support collection, not you, and it will not litigate your custody case at all.

Attorney Fee Awards

Attorney Fees: Leveling the Field

Parentage cases have their own fee-shifting statute FC §7605. The court may — and where the statutory findings show a disparity in access to funds and an ability to pay, must — order one parent to pay some or all of the other parent’s attorney fees and costs, so that each side can maintain representation. If the other parent controls the money, a properly supported fee request early in the case is often the single most important motion we file. We have litigated these requests extensively, including fee and forensic-cost awards in parentage matters.

The Parentage Process

How a Los Angeles Parentage Case Proceeds

  • Petition and service. The case opens with a Petition to Establish Parental Relationship, filed in the county where the child lives — for our clients, typically the Stanley Mosk Courthouse or a district family law department.
  • Temporary orders. A Request for Order gets you interim custody, visitation, and support orders — often early in the case, though timing varies by courthouse and by whether the posture is emergency or non-emergency. You do not have to wait for trial to have a schedule and support in place.
  • Parentage determination. By VDOP, stipulation, genetic testing, or adjudication of the presumptions.
  • Discovery. Income and expense declarations, document demands, and — in contested-income cases — subpoenas and forensic work.
  • Mediation, then hearing or trial. Most cases settle into a stipulated judgment with a parenting plan and support order. The ones that settle well are the ones prepared to be tried.

What Sets Us Apart

Why Duncan Family Law for a Parentage Case

Most firms treat parentage as the simple version of family law. We think that’s backwards. Parentage cases compress the two hardest parts of any divorce — custody and contested income — and remove the settlement leverage that property division usually provides. There is no house to trade. The only currencies are time with the child and money, which is exactly why these cases get personal fast.

Nicole Duncan brings the same complex-asset litigation discipline to parentage matters that defines the firm’s divorce practice: forensic-grade financial discovery, declarations built for the judicial officer who will actually read them, and trial preparation from day one. Your case is handled by the attorney you hire.

Parentage in California, answered directly

What is a parentage case in California?

A parentage case (also called a paternity case) is the legal action unmarried parents use to establish who a child’s legal parents are, and to obtain enforceable custody, visitation, and child support orders. It’s filed under California’s Uniform Parentage Act. Until parentage is legally established, the court cannot make custody or support orders.

I signed the Voluntary Declaration of Parentage at the hospital. Do I still need a court case?

A VDOP establishes that you are a legal parent — it has the effect of a judgment of parentage. But it does not create custody, visitation, or support orders. To get enforceable orders about time with your child or support, you still need to open a court case. The VDOP just means the parentage element is already done.

Do unmarried fathers have custody rights in California?

Yes. Once parentage is established, California law entitles both parents equally to custody, and the court applies the same best-interest standard used in divorce cases. But until a father establishes parentage and obtains orders, he has no enforceable right to time with his child — no matter how involved he has been.

How is child support calculated in a parentage case?

The same statewide guideline formula used in divorce: driven primarily by each parent’s income and timeshare. The disputes are almost always about the inputs — especially when a parent is self-employed, owns a business, or receives equity compensation. Support can generally be ordered retroactive to the date the petition or initial pleading was filed, subject to statutory service limitations under Family Code §4009 — if the paying parent was not served within 90 days of filing and was not evading service, support generally cannot begin before the date of service.

Can I get attorney fees paid in a parentage case?

Often, yes. Under Family Code §7605, the court may — and where the statutory findings show a disparity in access to funds and an ability to pay, must — order one parent to contribute to the other’s attorney fees and costs, so both sides have access to representation. If the other parent controls the money, this motion should come early.

Does a domestic violence finding affect custody in a parentage case?

Yes. Family Code §3044 applies in parentage cases exactly as in divorce: a DV finding within the previous five years creates a rebuttable presumption against awarding sole or joint legal or physical custody to the perpetrator.

How long does a parentage case take in Los Angeles?

If parentage is undisputed and the parents agree on a plan, a few months. Contested custody or complex-income disputes take longer — but temporary orders can usually be obtained early through a Request for Order, so you’re not without a schedule and support while the case proceeds.
